The following terms and conditions define the contractual relationship between the seller and the buyer and the conditions applicable to all purchases made through the commercial website www.florencecroisier.com whether the buyer is a professional or individual consumer. The purchase of a good through this site implies the buyer’s full acceptance of and consent to the present terms of sale.
These terms of sale prevail over all general terms or conditions that have not been explicitly agreed to by Florence Croisier creations.
Florence Croisier creations reserves the right to modify the terms of sale at any time. In this case, the applied conditions will be those in place at the time of the buyer’s order.
Characteristics of the proposed goods
The proposed goods are those that appear in the catalogue published on the website www.florencecroisier.com.
These goods are available within a maximum delay of 90 days counting from the date of the order to the date of shipping. This delay does not include shipping time for the goods. After this 90 day period, the buyer has the right to request the reimbursement of the amount paid without penalty. The catalogue photos are the most accurate possible but cannot guarantee a perfect resemblance with the product offered; each piece is entirely handmade and their unique character is important to Florence Croisier creations. Regarding colors, it is difficult to obtain a photograph which accurately represents color on metal. The colors are referenced with a color chart; they will be made with the greatest care to best resemble the model.
The prices that appear in the catalogue are in euros, tax included. In accordance with article 293b of the general tax code, the company is not subject to VAT.
Florence Croisier creations reserves the right to modify its prices at any time, with the understanding that the price appearing in the catalogue on the day of order will be the only price applicable to the buyer’s order.
The prices indicated include the cost of the order; they do not include shipping charges or taxes owed in countries outside of the European Union.
The on-line sale of the goods present on this website is reserved to buyers who reside in Europe, the United States of America, the DOM TOMs, Monaco, Canada, Australia and for deliveries requested within these geographical areas.
The buyer, who wishes to buy a product or service must necessarily :
- Confirm their order after having verified that it is correct
- Complete the order form providing all requested contact information and means of payment
- Make payment according to the terms and conditions of the website
Payment of the order implies the acceptance of the present sales terms, complete knowledge and agreement to these terms, and that the buyer declines the right to his define his own sales terms or other conditions.
All information supplied and recorded payment serve as proof of the transaction. The confirmation of payment is equivalent to a signature and the acceptance of the operations performed. The seller will send a confirmation of the received order via e-mail.
Buyers, individual consumers, not professionals, have a period of retraction of seven days from the day of delivery of their order to return the product to the seller for exchange of reimbursement without penalty; this does not include the shipping costs for the return of the order that are at the buyer’s expense. Orders are shipped to the address indicated on the order form which can only be in the geographical area indicated. The seller informs the buyer of the shipment by e-mail. This message will contain a summary of the articles shipped, the shipping address, the date of shipping, and the means of shipping (often with the tracking number).
The risks are at cost of the buyer from the moment the goods leave the site of Florence Croisier creations. In case of damage during transport, a complaint must be made by the buyer to the shipper within three days of shipment.
Shipping times are only approximate; an e-mail will be sent to specify the day of shipping if it is after the period indicated for each product in the catalogue.
If the shipping period exceeds the 90 days indicated, the buyer will be informed by e-mail. He will have a period of five working days to ask for the reimbursement of the order. Record keeping – Proof
The seller will archive all orders and bills of sale on a reliable and durable medium constituting an exact copy in conformity with article 1348 of the Civil Code. The digital registers of Florence Croisier creations will be considered by the parties as proof of the correspondence, orders, payments, and transactions that have transpired between them.
The present terms and conditions are subject to French law. In case of legal dispute, jurisdiction is given to the competent courts of Ivry or Val de Marne, not withstanding multiple defenders or appeal.
